Los Osos Man Found Guilty on Numerous Charges Relating to Home Invasion Robbery that Turned Deadly
A jury found a Los Osos man guilty on 7 of 8 counts in connection with a home invasion robbery and shooting that left a man dead. However, the jury in the trial for 22 year old Luke Waite on Tuesday deadlocked on a charge of murder through a provocative act in connection with the crime that took place in April of 2009 in Morro Bay.
Waite, along with Jason Graves, went to the residence armed and wearing masks, intending to rob four male friends who were playing poker inside. One of the intended victims wrestled a gun away from Graves adn shot and killed him, while Waite was shot and wounded. Waite is expected back in court on August 22nd for sentencing and faces a minimum of 90 years in prison before he is eligible for parole, but there will also be consideration on whether there will be a new trial on the murder count.
